Thank
you for visiting USA Volleyball's website. Your privacy is important
to us. To better protect your privacy, we provide this notice explaining
our online information practices and the choices you can make about
the way your information is collected and used at this site.
This
Privacy Policy complies with North American ( U.S. and Canada )
best privacy practices and follows all known legislation in North
American territories. Guests on USA Volleyball's web site from outside
of the United States and Canada are advised that USA Volleyball's
Privacy Policy does not necessarily follow the laws and regulations
of your home country, so USA Volleyball recommends that you NOT
provide personal information if you are not a resident of the United
States or Canada.
THE
INTERNET, PRIVACY, AND USA VOLLEYBALL
USA Volleyball's
policy is to respect and protect the privacy of our Members and
Guests. This policy statement tells you how we collect information
from you and how we use it. Using the Internet should be a fun experience
and we want to help you make it so.
The
Internet contains a wealth of information. Unfortunately, it may
also contain personal details about you that you don't want everyone
to know. For example, your real name (lots of people on the Internet
use aliases, alter egos, or nicknames), street address, phone number,
date of birth, or e-mail address. When you go online, sites that
you visit may be gathering information about you without your knowledge.
At USA Volleyball we strive to help our Members and Guests protect
their privacy while using our services.

USE
OF MEMBER AND GUEST INFORMATION
Although
information may be required to register as a member of USA Volleyball
or to participate in certain promotions or sales offered through
our web site, participants provide information on a voluntary basis
only. We collect directly from you, as the person requesting one
of our services, personal information about you in connection with
the following services.
- Applying for a membership with USA
Volleyball;
- Registering for a USA Volleyball-sanctioned
event;
- Making purchases from our online
store;
- Inclusion in our online newsletter
program;
- Participation in any online contests,
sweepstakes or other promotions we might offer;
- Questions or comments sent through
our web site;
- Registration to become a registered
user of our site.
If
your Club Representative is attempting to purchase a membership
for you, or to renew your membership, to edit your membership information,
or to register you for a USA Volleyball-sanctioned event, we also
collect personal information about you from your Club Representative.
Collection of personal information for these services may include
the collection of your name, address, telephone number, e-mail address,
date of birth, gender, (and if you are registering yourself, the
last 4 digits of your credit card number). For some of the other
services mentioned above, we may also ask you for demographic information,
age range, and interests. USA Volleyball needs to collect this information
for fulfilling purchases, verifying qualification to participate
in our sanctioned events, tracking/verifying compliance with USA
Volleyball's policies and federal, state, and local laws and for
editorial and feedback solicitation purposes.
The
personal information that you provide to apply for membership, subscribe
to our magazine or on-line newsletter, to purchase items from us,
or to register as a user of our site is used within the USA Volleyball
National Office to provide the services that we offer to you. However,
be assured that USA Volleyball will not disclose your personal information
to third parties without your consent.
USA
Volleyball may disclose Member or Guest information in special cases
when we have reason to believe that disclosing this information
is necessary to identify, contact or bring legal action against
someone who may be causing injury to or interference with (either
intentionally or unintentionally) USA Volleyball's rights or property,
other USA Volleyball site Guests, or anyone else that could be harmed
by such activities. USA Volleyball may disclose Member or Guest
information when we believe in good faith that the law requires
it.
USA
Volleyball shares aggregate information about our Members and Guests
with advertisers, business partners, sponsors and other third parties.
For example, we may say that USA Volleyball's audience is x percent
female and y percent male. This data is used to customize USA Volleyball's
online content and advertising, to deliver a better experience for
our Members and Guests. All information that we collect that is
specific to a particular Member or Guest is used only internally
and is not shared with any third party unless a Member or Guest
specifically requests that it be shared with third parties, or specifically
requests to receive information from a third party.
In
case you change your mind or some personal information about you
changes (such as your address ZIP code), we will endeavor to provide
a way to correct, update, or remove the personal data you give us.
You can do this by: (1) making changes on our site using your user
ID and password for access; or (2) by sending an e-mail to us at
postmaster@usav.org; or (3) by simply following the instructions
in our e-mail newsletter to make changes or remove yourself from
our list(s).
However,
certain of that personal information (such as name, address, birth
date, and gender) is essential to maintaining a membership account
with USA Volleyball, or registering to participate in our events,
and without it we cannot maintain your membership or allow you to
participate in USA Volleyball events. If you attempt to make delete
some of the personal data on our site and the system will not allow
you to do so, it is because that information is mandatory for our
member database. If you ask that we remove it, we may have to advise
that it will forfeit your membership and make you ineligible to
participate in USA Volleyball-sanctioned events.
OPTING
OUT
Information
provided at the time of registration or submission from a Member
or Guest who is 13 years of age or over may be used for marketing
and promotional purposes by USA Volleyball. To keep you in control
of your personal information and the communications directed to
you, we allow you to opt out of the following services: receiving
communications from USA Volleyball about new features or services,
and receiving communications about offers from third-party companies
that offer a product or service that we think would be of value
to you. If a Member or Guest objects to such use for any reason,
he/she may stop that use -- either by e-mail request to postmaster@usav.org
or by modifying his/her member information online.
POLICIES
FOR KIDS (INDIVIDUALS UNDER 13 YEARS OF AGE)
USA
Volleyball encourages parents and guardians to spend time online
with their children and to participate in the activities offered
on our site. We encourage parents and guardians to take an active
role to protect the privacy of their children and to prevent inappropriate
use of information about their children. No information should be
submitted to or posted on the USA Volleyball site by Members or
Guests under 13 years of age without the consent of their parent
or guardian. Parents and guardians should instruct their children
never to give out real names or any other identifying information
over the Internet without first getting parental permission.
Unless
otherwise disclosed during collection or in this privacy policy,
USA Volleyball does not provide any personally identifying information,
regardless of its source, to any third party for any purpose whatsoever
from our Members or Guests under 13 years of age. All members who
register on line receive an e-mail confirming their registration.
In addition, when a Member or Guest under 13 registers, he/she is
required to provide the e-mail address of his/her parent or guardian
and that parent or guardian receives an e-mail alerting them of
that registration. We do not condition your child's participation
in an activity on your child's disclosure of more personal information
than is reasonably necessary to participate in the activity.
No
information collected from Members or Guests under 13 years of age
is used for any marketing or promotional purposes whatsoever, either
inside or outside USA Volleyball's site(s), except as explicitly
stated during registration for membership or for contests or promotions
(and in that case, the information collected is used only for the
purpose of registering the member, or for the specific contest or
promotion).
The
parent or guardian has the option to agree to the collection and
use of the child's information without consenting to the disclosure
of the information to third parties. USA Volleyball shall not require
a child to disclose more information than is reasonably necessary
to participate in an activity as a condition of participation. The
parent or guardian can review the child's personal information,
ask to have it deleted and refuse to allow any further collection
or use of the child's information. USA Volleyball may change the
contents of any personal information of a child maintained by USA
Volleyball at the request of the child, parent or guardian. To review
the child's personal information, ask to have it deleted, refuse
to allow any further collection or use of the child's information,
or to modify the information, a parent must contact USA Volleyball
using the methods provided below under the section titled "Contacting
Us About Application Of This Policy."
However,
deletion of the information necessary to maintain the child as a
Member (such as name, address, birth date, and gender) will void
the membership and will make the child ineligible to participate
in USA Volleyball-sanctioned events.
USE
OF IP ADDRESSES
An
IP address is a number that is automatically assigned to your computer
whenever you're surfing the Web. Web servers -- the computers that
produce web pages -- automatically identify your computer by its
IP address.
USA
Volleyball collects IP addresses for the purposes of system administration,
to report aggregate information to our advertisers and others, and
to audit the use of our site. When Guests request pages from USA
Volleyball site, our servers log the Guests' IP addresses. We do
not normally link IP addresses to anything personally identifiable,
which means that a Guest's session will be logged, but the Guest
remains anonymous to us. We can and will use IP addresses to identify
a Guest when we feel it is necessary to enforce compliance with
our house rules, or terms of service, or to protect our service,
site, customers, or others.
Some
services within the USA Volleyball site, such as certain message
boards, may in the future display IP addresses along with the message-poster's
name and message. Please review each service prior to using it and
only use those that disclose information you are comfortable with

to register as a member of USA Volleyball, and "click"
on the "Join USA Volleyball" terminology, the "click"
will take you off the USA Volleyball site to the company who manages
our on-line registration services. That company is not a third party.
It is an operator of our website who provides internal support services
for us. It cannot use your personal information for any other purpose.
However,
our site also includes links from advertisers, sponsors, and partners
that may use USA Volleyball logo as part of a co-branding or other
agreement. Their information practices may be different from ours.
They may send their own cookies to Members and Guests who use the
link, and they may collect data or solicit personal information.
We make every effort to link only to sites that meet similar standards
for maintaining each individual's right to privacy. However, USA
Volleyball cannot control any of these links and is not responsible

SECURITY
The
importance of security for all personally identifiable information
associated with our Members and Guests is of utmost concern to us.
We exercise great care in providing secure transmission of your
information from your PC to our servers. Unfortunately, no data
transmission over the Internet can be guaranteed to be 100% secure.
As a result, while we strive to protect your personal information,
USA Volleyball cannot ensure or warrant the security of any information
you transmit to us or from our online products or services, and
you do so at your own risk. Once we receive your transmission, we
make our best effort to ensure its security on our systems. When
credit card information is transmitted, we use industry-standard
SSL (secure socket layer) encryption.
Your
USA Volleyball account is password-protected so that only you and
the Club Representative of your Club can access it. Your Club Representative
does not have access to your password; rather, s/he has a unique
password as Club Representative that allows him or her to view the
member information relevant to your membership, so that s/he can
register you as a member, renew your membership, or update your
member information (for example, your name, address, phone number,
e-mail address, and date of birth). As we install our on-line event
management system, your Club Representative will also be able to
register you for a USA Volleyball-sanctioned event. However, your
Club Representative does not have access to other information in
our system, such as what items you have purchased.
We
recommend that you do not divulge your password to anyone. USA Volleyball
will never ask you for your password in an unsolicited phone call
or e-mail. Ultimately, you are responsible for maintaining the secrecy
of your password and any account information.
Remember
to sign out of your USA Volleyball account and close your browser
window when you have finished your work. This is to ensure that
others cannot access your personal information and correspondence
if your computer is accessible to others or if you share a computer
with someone else or are using a computer in a public place like
a library or other shared computer.
YOUR
ACCEPTANCE OF THESE TERMS
By
using this site, you signify your assent to USA Volleyball's Privacy
Policy. If you do not agree to this policy, please do not use our
site. USA Volleyball reserves the right to delete information or
to change its Privacy Policy, at any time. Your continued use of

These
terms shall be governed by and construed, in accordance with the
laws of the State of Indiana , without giving effect to any principles
of conflicts of law. You agree that any action at law or in equity,
arising out of or relating to these terms, shall be filed only in
the state or federal courts located in Colorado Springs , Colorado
, and you hereby consent and submit to the personal jurisdiction
of such courts for the purposes of litigating any such action. If
any provision of these terms shall be unlawful, void, or for any
reason unenforceable, then that provision shall be deemed severable
from these terms and shall not affect the validity and enforceability
of any remaining provisions. The failure of USA Volleyball to exercise
or enforce any right or provision of these Terms and Conditions
of Use shall not constitute a waiver of such, or any other, right
or provision. This is the entire agreement between us relating to
the subject matter herein and shall not be modified except in writing,
signed by both parties.

PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT INFRINGEMENT
Notification
must be submitted to the following Designated Agent:

To
be effective, the notification must be a written communication that
includes the following:
1.
A physical or electronic signature of a person
authorized to act on behalf of the owner of an exclusive right that
is allegedly infringed;
2.
Identification of the copyrighted work claimed
to have been infringed, or, if multiple copyrighted works at a single
online site are covered by a single notification, a representative
list of such works at that site;
3.
Identification of the material that is claimed
to be infringing or to be the subject of infringing activity and
that is to be removed or access to which is to be disabled, and
information reasonably sufficient to permit the service provider
to locate the material;
4.
Information reasonably sufficient to permit
the service provider to contact the complaining party, such as an
address, telephone number, and, if available, an electronic mail
address at which the complaining party may be contacted;
5.
A statement that the complaining party has
a good-faith belief that use of the material in the manner complained
of is not authorized by the copyright owner, its agent, or the law;
and
6.
A statement that the information in the notification
is accurate, and under penalty of perjury, that the complaining
party is authorized to act on behalf of the owner of an exclusive
right that is allegedly infringed.
